YOURAPP SPACE Privacy Policy

This Privacy Policy describes the information that we gather on or through the Services, how we use and disclose such information, and the steps we take to protect such information. By visiting the Site (website yourappspace.com.), or by purchasing or using the Services, you accept the privacy practices described in this Policy.

 

This Policy is incorporated into, and is subject to, the YOURAPP SPACE Terms of Service.

 

As used in the Policy, the following defined terms shall apply:

 

Agreement means YOURAPP SPACE Terms of Service and any other related documents.

“Controller” means the entity that has certain legal rights to determine the purposes for which Personal Data will be Processed and the means by which that Processing will happen.

Customer or the term “you” means the legal entity or individual that has ordered any Services from YOURAPP SPACE.

For example: When a business purchases a Subscription and sets up accounts under that Subscription for employees, the business is the Customer, and each individual using the Services under the Subscription is a User. If a one-person business signs up for its own free Subscription, that person is both the Customer and the User.  If that person invites others to set up accounts under that Subscription, those other people will be Users as well.

Customer Account means an account for Customer that is required to access and use the Services.

Customer Data means all data or information submitted by or on behalf of Customer to the Services, but does not include Aggregated Anonymous Data.

Personal Data means any information about an identified or identifiable individual, such as their name or contact information.

Privacy Shield means EU-U.S. and Swiss-U.S. Privacy Shield Principles described here.

Process, Processed, and Processing refer to any operation or set of operations that can be performed on Personal Data or on sets of Personal Data.  This includes, for example, collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure and destruction.

Processor means an entity that Processes Personal Data on behalf of a Controller.

Services means the generally available YOURAPP SPACE Software-as-a-Service (“SaaS”) offerings inclusive of any services delivered by YOURAPP SPACE through any unified, hosted YOURAPP SPACE service delivery platform, including any on-premises components (e.g., client software, tools).

Site means YOURAPP SPACE web site available by link yourappspace.com.

Subscription means Customer’s paid subscription to the Services pursuant to the applicable Order or Order Form.

User means an individual that is authorized by Customer to access the Services through Customer’s assignment of a single user ID.

YOURAPP SPACE or Company or “us” or “we” or “our” means YOURAPP SPACE LTD, the owner of the Web site yourappspace.com and the provider of the Services.

Workspace means the Services instance to which a Customer gains access when entering into a Subscription.

 

What information we collect about you

We collect information about you when you provide it to us, when you use our Services, and when other sources provide it to us, as further described below. 

 

Information you provide to us: We collect information about you when you input it into the Services or otherwise provide it directly to us.

 

Account Information:  We collect information about you when you register to use the Services and otherwise provide contact information to us via email, phone, or chat. This information may include your username, first and last name, email address or phone number.

 

Customer Data: A User may store or upload various data into the Services, including information about their own clients and other business data, as well as other Users of the Services, such as colleagues. YOURAPP SPACE has no direct relationship with the individuals whose Personal Data it hosts as part of Customer Data. Each Customer is responsible for providing notice to People concerning the collection and storage of Customer Data in the Service.

 

Content you provide through our Site: The Services encompass our owned or operated websites. We gather additional content that you contribute to these websites, including those associated with social media or social networking, which we oversee. This involves submitting content when you offer feedback or engage in interactive features, surveys, contests, promotions, sweepstakes, activities, or events.

 

Payment Information:  We obtain payment and billing details when you sign up for paid Subscription. During registration, we request that you assign a billing representative, providing their name and contact information. Additionally, you may furnish payment information, such as payment card details, which we collect using secure payment processing services.

 

Information we collect automatically when you use the Services: We collect information about you when you use our Services, including browsing our websites and taking certain actions within the Services.

 

Device and Connection Information: We collect information about your computer, phone, tablet, or other devices you use to access the Services. This device information includes your connection type and settings when you install, access, update, or use our Services. We also collect information through your device about your operating system, browser type, IP address, URLs of referring/exit pages, device identifiers, and crash data.

 

Cookies and Other Tracking Technologies: YOURAPP SPACE and our third-party partners, such as our advertising and analytics partners, use cookies and other tracking technologies (e.g., web beacons, device identifiers and pixels) to provide functionality and to recognize you across different Services and devices.

YOURAPP SPACE uses Personal Data as follows:

§   To provide and enhance our Services, including internal analysis of aggregate usage patterns.

Additionally, we may anonymize or aggregate personal information and employ it for the aforementioned purposes and other purposes as allowed by applicable laws. Furthermore, we may use Personal Data for supplementary purposes that we specify at the time of collection, with your consent as required by applicable law.

Disclosures of Personal Data

We share Personal Data as follows:

§   For the purposes outlined in the information above, including making necessary disclosures as required by legitimate requests from public authorities. This may include meeting national security or law enforcement obligations.

§   In association with a real or anticipated business transaction, such as a sale, merger, consolidation, change in control, transfer of substantial assets, or a reorganization.

§   Entities that help us with any of the above, such as our sub-processors, data storage and backup providers, marketing service providers, customer relationship management providers, accounting providers, technical service providers, our payment processor, and analytics companies;

§   Other entities involved in the legal-related matters; or

§   Other entities involved in the significant corporate transactions, such as an acquirer of YOURAPP SPACE.

How we store and secure information we collect

We employ industry-standard technical and organizational measures to ensure the security of the information we retain. While we diligently implement protective measures to safeguard your data, it's important to acknowledge that no security system is entirely impervious to breaches. Given the inherent characteristics of the internet, we cannot provide an absolute guarantee that your information, whether in transit over the internet, stored on our systems, or under our care, will remain completely immune from unauthorized access.

 

The responsibility for securing the storage and accessibility of the data you input into our Services ultimately lies with you and not YOURAPP SPACE. We highly recommend that users of our servers or data centers configure SSL protocols to prevent data interception during transmission over networks and to impose stringent access controls on the databases and storage locations in use.

How long we keep information

The duration for which we retain the information we gather from you depends on the type of data, as elaborated below. Upon reaching the specified timeframe, we will either erase or de-identify your data. In cases where deletion isn't immediately feasible, such as when information is stored in backup archives, we will securely maintain and isolate your data from further use until it can be deleted securely.

 

Account information: We preserve your account details for the duration of your active account and for a reasonable period afterward in the event you choose to reactivate the Services. We also retain certain information to fulfill our legal obligations, address disputes, enforce agreements, support business operations, and continually enhance our Services. When retaining data for service enhancement and development, we take measures to remove personally identifiable information, utilizing the data solely to uncover collective insights regarding the use of our Services, without specifically analyzing individual characteristics.

 

Information shared on the Services: In cases where your account is deactivated or disabled, specific information and content you've provided will persist. This allows your team members or other users to fully utilize the Services. For instance, we will continue displaying messages sent to users who received them and retain the content you've contributed. However, upon request, details that could identify you will be removed.

 

Managed Accounts: If you access the Services through an organization (e.g., your employer), we will keep your information for as long as the account administrator deems necessary.

 

How to access and control your information

All Users can:

§   Review and update certain User information by logging in to the relevant portions of the Services.

§   Deactivate their accounts by reaching out to us, with this action subject to any contractual provisions between YOURAPP SPACE and the Customer for the account. However, unless the Customer has requested the closure of all user accounts, information in a deactivated user account may remain accessible to the Customer for a certain period.

§   Controls related to cookies and other automated data collection.  Anybody can unsubscribe from marketing emails by clicking the unsubscribe link they contain.

Residents of the European Economic Area, the UK and many other jurisdictions have certain legal rights to do the following with Personal Data we control:

§   Obtain confirmation of whether we hold Personal Data about them, and to receive information about its Processing;

§   Obtain a copy of the Personal Data, and in some cases, receive it in a structured, commonly used and machine-readable format, or have it transmitted to a third party in such form;

§   Update, correct or delete the information;

§   Object to our Processing of the information for direct marketing purposes;

§   Object to other Processing of the information; and/or

§   Withdraw consent previously provided for the Processing of the information.

 

Residents of the European Economic Area, the UK and Switzerland also have certain rights under the Privacy Shield, as described in the “ How we transfer information we collect internationally” section below.

To exercise any of those rights with respect to the Personal Data YOURAPP SPACE controls, individuals should contact us as described at the end of this Privacy Policy.

 

To exercise any rights related to Customer Data, Users should reach out to the respective administrator responsible for the Workspace associated with the Customer Data, rather than contacting YOURAPP SPACE directly.

However, if you are a Customer account administrator or the owner of a Customer account and need assistance with this process, such as when making a request concerning your own Customer data, please feel free to contact us using the information provided below.

 

Please be aware that many of the rights outlined above are subject to significant limitations and exceptions as dictated by applicable law. For instance, objections to the Processing of Personal Data and withdrawals of consent typically do not have a retroactive effect.

How we transfer information we collect internationally

We collect information globally and may transfer, process, and store your information outside of your country of residence, to wherever we or our third-party service providers operate for the purpose of providing you the Services.  Whenever we transfer your information, we take steps to protect it.

 

YOURAPP SPACE complies with the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom and Switzerland to the United States in reliance on Privacy Shield. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, YOURAPP SPACE commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact YOURAPP SPACE at contact@yourappspace.com.

YOURAPP SPACE is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC) to ensure compliance with the EU-US Privacy Shield Principles and the Swiss-U.S. Privacy Shield Principles outlined in this notice.

Under certain conditions, more fully described on the Privacy Shield website https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint, you may also be able to invoke binding arbitration when other dispute resolution procedures have been exhausted.

YOURAPP SPACE shall comply with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

Other important privacy information

In our commitment to safeguarding Customer Data within our Services, we employ a combination of physical, organizational, and technical security measures. These measures undergo periodic updates and enhancements to stay ahead of evolving threats. The specific security options available to Customers depend on their Subscription, and the extent to which Customers utilize these safeguards directly influences the level of protection afforded to their Customer Data. Please note that communications with YOURAPP SPACE via alternative methods, such as email or phone, do not benefit from these protections. Furthermore, third-party software and services integrated into our Services, such as Google Drive, Elastic Search, and other similar integrations, are managed by these third parties and are subject to their own independent privacy and security protocols, which we do not oversee.

We employ distinct security measures to ensure the protection of other Personal Data under our purview.

 

It's important to acknowledge that while we prioritize security, no security method is infallible, and we cannot provide an absolute guarantee that all data will remain impervious to threats.

 

We retain Personal Data for the duration necessary to fulfill the objectives outlined in this Privacy Policy. Additionally, information may persist in backup copies created for the purposes of data backup and business continuity for extended periods.

Notification of Changes

YOURAPP SPACE reserves the right to modify this Privacy Policy to align with evolving legal requirements, our data management procedures, or advancements in our business operations. Any revisions to the Privacy Policy will be made available on our Site.
